Print Savers Terms & Conditions

1. General Information 

Welcome to Vogue Print Savers (abn 47 578 898 029), herewith referred to " Print Savers ", "We" and "Us."

By registering as a client and using this service, you agree to our terms and conditions, return and refund and privacy policy. 

If you don't accept the terms and conditions as set out below, do not access our web site, mobile application or our services through any related site.  

We may update these terms and conditions from time to time and suggest you review them every now and again. 

Once you have completed your registration via our web site or mobile application you may use our services.

We only allow one registration for each genuine email address. We will use your email address to send you notifications. 

2. Order Acceptance & Payment 

Orders are only accepted and processed in accordance with the following terms and conditions. By making use of Print Savers you implicitly accept these terms and conditions. 

An order for products becomes binding upon 'checking out' and paying for it through either the web site, mobile application or any other associated sites. As our products are personalized, once an order is placed it cannot be cancelled or adjusted. 

However, if you have placed an order in error, please contact us and we will endeavour to comply with your request, but cannot promise it will be possible. 

Please ensure you review your order carefully before checking out and paying for it. 

All product and service prices are Australian currency (AUD) and Print Savers provides a secure payment gateway via PayPal and all charges are processed immediately. 

3. Delivery 

Upon receipt of your order, it will be printed within 1 to 21 business day via Australia Post or another third party carrier to the nominated address depending on the product selected. 

Delivery of your order by Australia Post or another third party carrier may take between 1 and 14 depending on where in the world you are located. We endeavour to have your order shipped within the timeframe listed under our 'shipping information' on our web site and mobile application. 

However, we cannot accept responsibility for delivery failures or delay by Australia Post or any other third party carrier. 

We will deliver all products to the nominated address either on your order or within your uploaded address spreadsheet and we cannot accept any responsibility for incorrect addresses. 

We may, at our discretion, part ship orders. 

4. Age 

You agree that you are at least 18 years of age or between 13 and 17 years and have your parent or guardians permission to use this service. Persons under the age of 13 are not permitted to use this service. 

5. Copyright 

You are responsible for ALL content in the files provided to Print Savers and Print Savers cannot accept any liability for what is contained within said file. 

Copyright law states that the person who creates or takes the photograph or image owns the said image or photograph. 

By using this service you represent and warrant to us that you own the copyright or have permission from the owner of the copyright to submit the said image or photograph to this service. 

You hereby grant Print Savers a non-exclusive, royalty free right to copy, display, modify, transmit and make derivative works of and distribute your content. 

If any claim is made, including but not limit to copyright or intellectual property or moral right infringement, you will indemnify Print Savers and associated companies, our employees, our agents, our suppliers and contractors against all costs, claims, loss, damages, demands and expenses (including all legal costs, fees and expenses) arising directly or indirectly from such claims.

6. Indemnity 

You Will Indemnify, Defend And Hold Harmless Print Savers, and each of Its Officers, Directors, Employees, Affiliates, Licensors, Suppliers, Information Providers, And Agents (Collectively "Print Savers Affiliates") From And Against All actions, Losses, Claims, Liabilities, Expenses, Damages And Costs, Including Reasonable Attorneys' Fees, which any of them suffer or incur Resulting From Any Violation Of These Terms and conditions Or Any Activity Related To The Service (Including Negligent Or Wrongful Conduct) By You Or By Any Other Person Accessing The Service As Your Invitee, Such As By Using Your Account. 

7. Limited Warranty 

(a) No liability for content: in no event will Print Savers or Print Savers' Affiliates be liable for any claim of any nature, whether direct or indirect, arising from or related to: (i) content made available on or through the service, including errors or omissions in such content; or (ii) loss or damage incurred as a result of such content. 

(b) Exclusive remedy: any product or service made available through the service is provided on an "as is" and "as available" basis. Your use of the service is at your own risk. Print Savers warrants only that photographic materials provided will be returned to you in usable condition. 

If your film, prints, or negatives are damaged, of unacceptable quantity or quality, or lost or not returned, Print Savers' sole obligation, and your sole and exclusive remedy, will be for Print Savers to either: (i) refund the full amount of the purchase price of such prints; or (ii) reprint the photos at no extra cost. 

(c) Disclaimer: except for the above express limited warranty in paragraph 7(b), to the extent permitted under applicable law, Print Savers and Print Savers Affiliates expressly disclaim all warranties of any kind, whether express or implied, including the implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement. 

Print Savers makes no warranty that: 

(i) the service will be provided in a manner that is uninterrupted, timely, secure, or error free, 

(ii) the service is or will be free of viruses or other harmful components, or 

(iii) the service will meet your requirements. Print Savers makes no warranties of any kind with respect to software, goods, or services that are purchased, accessed, or obtained through the service or that are advertised on the site, including that software will be free of corruptive code. 

Any material downloaded or otherwise obtained through the use of the service is at your own discretion and risk. You will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material. 

(d) Remedies: To the fullest extent permitted under law, the remedies set forth in these terms and conditions are your sole and exclusive remedies.  

8. Termination of Service 

We may, at our sole discretion, suspend or terminate your use of this service, or any part of this service, and may remove and or discard any content at any time, with 2 day notice, for any reason including any breach of these terms and conditions. If your account is terminated we will, at our discretion, fulfil or cancel any order accepted by us prior to termination. 

9. Returns & Refunds 

Print Savers intends for you to be completely satisfied with our products and services, but if for any reason you are not, please contact our support team immediately via PO Box 1142, Research, Victoria 3095 Australia and return (at your expense) your faulty item within 7 days of receiving it. 

Once the fault has been identified by our support team they will contact you to discuss the remedy which may include either a replacement, repair or a refund (of product and return postage). 

We will not accept responsibility to provide a replacement or refund if: 

a) poor quality prints or photo gifts are produced because low resolution or poor quality images were uploaded by you; 

b) spelling, punctuation or accuracy errors were made by you; and 

c) incorrect image or text placement, incorrect boarder or background selection, incorrect cropping or formatting, incorrect font size, incorrect paper colour or finish, incorrect product style or size were selected by you. 

No claim may be made after 14 days of purchase. This policy doesn't intend to exclude or limit your rights or remedies available to you by the Competition and Consumers Act 2010 (Cth). 

10. Illegal Use 

 You warrant that you will not use any of the services for any fraudulent or illegal purposes and that you will not submit any image that: 

a. Is unlawful, abusive, deceptive, pornographic, obscene, defamatory, slanderous, offensive, 

b. Comprises any patent, trademark, trade secret, intellectual property or copyrighted 

c. Violates or otherwise encroaches on the rights of others including their right to privacy; 

d. Contains viruses, worms, corrupt files, Trojan horses or other forms of corruptive code, or 

e. Assist with or advocates illegal activity or violate the rights of any party; or 

f. Harms to (or depicts harming) anyone, including children in any way; or, 

g. Provides a link to any of the above, collectively ("Prohibited Content"). 

Print Savers has the sole discretion to determine whether your content is Prohibited Content, and any content you submit or transmit to the service may be subject to examination from time to time.

Although Print Savers does not and will not examine or otherwise review all content you submit or transmit to the service, Print Savers may delete, move, and edit your content for any reason, at any time, without notice. 

You agree to inform Print Savers if there is a breach by your or each of your directors, officers, employees and agents, of any of these terms and conditions. 

or otherwise inappropriate: material used without the express permission of the owner; 

any other content which may compromise the Service (collectively "Corruptive Code"); 

You agree that you will be liable for any action taken against Print Savers and will fully indemnify us against all actions, claims, demands and costs associated with your illegal use of our services. 

We are obligated to report any illegal use of this service to the authorities. 

11. Intellectual Property 

All (but not limited to) logos, trademarks, software, design, graphics, text, photos, data, copyright, icons, templates, sound and video recordings are the intellectual property of Print Savers and using the services does not give you ownership of any intellectual property rights in the services. 

Except as expressly authorised by these terms & conditions or by law, you may not in any form or by any mean copy, modify, adapt, store, transmit, create derivative works or commercialise any information, products or services obtained from Print Savers web site, mobile application or other related sites. 

12. Privacy 

These terms and conditions will be governed and interpreted by the laws of Victoria, Australia and are subject to the jurisdiction of the Victorian courts.
